Acceptance of Terms
Welcome to BingeAmigo. These Terms & Conditions ("Terms") govern your access to and use of the BingeAmigo mobile application and web app (collectively, "the Service"), operated by BingeAmigo ("we", "us", or "our").
By creating an account or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use BingeAmigo.

Eligibility
You must be at least 13 years old to use BingeAmigo. By using the Service, you represent and warrant that you meet this age requirement.
If you are between 13 and 17 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly permit children under 13 to create accounts. If we discover that a user is under 13, we will promptly delete their account and all associated data.

Your Account
To use most features of BingeAmigo, you must create an account. You are responsible for:
- Providing accurate and up-to-date registration information.
- Keeping your login credentials confidential.
- All activity that occurs under your account, whether or not you authorized it.
You may not create more than one account per person or create an account on behalf of someone else without their explicit consent. Accounts are personal and non-transferable.
If you believe your account has been compromised, notify us immediately at contact@bingeamigo.com.

User-Generated Content
BingeAmigo lets you post reviews, ratings, and other content ("User Content"). By submitting User Content, you grant BingeAmigo a worldwide, royalty-free, non-exclusive license to store, display, and distribute that content within the Service for the purpose of operating and improving the app.
You retain ownership of your User Content. However, you represent and warrant that:
- You have the right to post the content and it does not infringe any third-party rights.
- The content does not violate applicable law or these Terms.
- The content is not false, misleading, defamatory, obscene, or harmful.
We do not pre-screen User Content but reserve the right to remove any content that violates these Terms at our sole discretion, without prior notice.

Prohibited Conduct
You agree not to use BingeAmigo to:
- Post content that is abusive, harassing, threatening, hateful, or discriminatory.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- Spam, flood, or repeatedly post the same content.
- Attempt to gain unauthorized access to other users' accounts or our systems.
- Scrape, crawl, or otherwise extract data from the Service by automated means without our written permission.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Exploit bugs or glitches to earn XP, levels, or other in-app rewards fraudulently.
- Violate any applicable local, national, or international law or regulation.
Violations may result in immediate account suspension or permanent termination, at our sole discretion.

XP, Levels & Game Features
BingeAmigo includes an experience point (XP) and leveling system designed to make tracking shows more fun. Please note:
- XP and levels have no monetary value and cannot be exchanged for cash, goods, or services.
- We reserve the right to adjust XP values, level thresholds, caps, or any other aspect of the game system at any time, for any reason, without prior notice.
- XP or progress may be reset, modified, or removed if your account is found to have violated these Terms.
- We make no guarantee that any particular XP balance or level will be maintained indefinitely.

Intellectual Property
All content, design, code, trademarks, logos, and other materials that make up BingeAmigo — excluding User Content and third-party content — are the exclusive property of BingeAmigo and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
Show and movie metadata, posters, and descriptions are provided by The Movie Database (TMDb) and are subject to TMDb's own terms and licenses. BingeAmigo is not endorsed or certified by TMDb.

Third-Party Services
BingeAmigo integrates with third-party services including Google Firebase (authentication and data storage) and TMDb (content metadata). Your use of those services is subject to their respective terms of service and privacy policies.
We are not responsible for the availability, accuracy, or practices of any third-party service. Links or references to third-party content do not constitute our endorsement.

Disclaimers
BingeAmigo is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
We make no representations about the accuracy or completeness of any show or movie information displayed in the app, as this data is sourced from TMDb and other third parties.
To the fullest extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability
To the maximum extent permitted by law, BingeAmigo and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Service, including but not limited to loss of data, loss of XP or in-app progress, or unauthorized access to your account.
Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed USD $10 or the amount you paid us in the twelve months preceding the claim, whichever is greater. Because BingeAmigo is free to use, this amount is typically zero.
Some jurisdictions do not allow certain liability exclusions; in such cases, our liability is limited to the minimum extent permitted by law.

Account Termination
You may delete your account at any time, directly within the app, with no restrictions or waiting periods. Deletion is permanent and cannot be undone.
We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have violated these Terms, engaged in abusive behavior, or posed a risk to the safety of other users or the integrity of the Service.
Upon termination, your license to use the Service ends immediately. Sections 4 (the license you granted us for User Content already published), 7, 9, 10, and 12 of these Terms survive termination.

Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Mexico, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Mexico.
If you are located in the European Economic Area, you may also be entitled to raise a complaint with your local data protection authority or consumer protection body. We will always attempt to resolve disputes informally first — please contact us before initiating formal proceedings.

Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will notify you via email or an in-app notice at least 7 days before the change takes effect.
Your continued use of BingeAmigo after revised Terms take effect constitutes your acceptance of those changes. If you disagree with the new Terms, you should stop using the Service and delete your account.

BingeAmigo is operated from Mexico. These Terms are written in English; in the event of a conflict between any translation and the English version, the English version shall prevail.
